Mr. Rafael V. Baca possesses experience in all aspects of Intellectual Property law including U.S. and international patent & trademark prosecution, litigation, licensing and case management of innovative internet based networks, electrical and mechanical engineering systems for large corporations, institutions, and individual business owners. To date, Mr. Baca has written well over a decade’s worth of patent applications in engineering and applied scientific fields in the electrical arts. His most recent patent experience includes wireless and telecom networks, oil & gas technologies, as well as informatics & medical devices.   With his exceptional communication and interpersonal skills, Mr. Baca has effectively negotiated many business and litigation agreements and has managed key IP portfolios.
Representative Experience:
Mr. Baca possesses experience gained in patent prosecution and licensing in the electrical arts for computer-based and wireless companies as well as Internet startups including Motorola, Dell Computer Corporation, Hewlett-Packard Printer Division, and IBM Corporation among others.
Mr. Baca acquired further experience in nanotechnology and microdevices, signal processing, pulsed-LASER technology, ballistics, and aerospace navigation.
Mr. Baca gained additional patent prosecution experience while working at the United States Patent and Trademark Office and at a law firm guided by former patent examiners. Accordingly, as an associate with the firm, Mr. Baca gained experience in the fields of electromechanical and biomechanical control systems, beverage industry patents, including foreign patent filings. Mr. Baca obtained further patent prosecution and litigation experience for large corporate clients including Coca-Cola, The Univ. of Texas System, Texas A&M System, Sandia National Laboratories, Lockheed Martin Aerospace, Auto suppliers to domestic and foreign automakers, European clients such as Thule Sweden and many well-known Latin American companies.  Mr. Baca has experience in legal research and writing, including topical papers written for local IP legal professionals and often with a special focus on Mexico’s Industrial Property Law and is fluent in Spanish.  He is actively interested in all aspects of U.S. and Latin American Intellectual Property Laws and has partnered the with Monterrey Tech in Mexico to bridge IP interests between the U.S and Latin America.
In addition to drafting patent applications and responses, Mr. Baca has extensive patent litigation experience, which includes drafting motions for courts nationwide as well as managing various facets of discovery for international and domestic clients.
Mr. Baca also served as a law clerk at the Sandia National Laboratories Technology Transfer Center (a national nuclear and Homeland Security laboratory managed by Lockheed-Martin) where he worked on projects involving CRADAs and licensing agreements with Fortune 100 Companies. He also held a Law Clerk Internship at the U.S. Patent and Trademark Office where he worked with the Examining Corps examining applications for medical devices and wrote First Actions, Elections of Species, and Examiners’ Answers. While at the USPTO, he worked as a law clerk in the Office of Special Programs for the Assistant Commissioner for Patents where he performed legal research on the current twenty-year patent term, and did editorial work on the Manual of Patent Examining Procedure (MPEP).
Mr. Baca received his B.S. in Mechanical Engineering from the University of New Mexico where we was Mechanical Engineering Senior of the Year.  Mr. Baca was a member and national chair of Tau Beta Pi (National Engineering Honor Society), the National Dean’s List and others.
Mr. Baca received his law degree from the University Of New Mexico School Of Law where he was a senior editor of the New Mexico Law Review. He has published articles in several notable journals, such as IDEA: Journal of Law and Technology, a prominent patent practice journal that is circulated to examiners within the USPTO and les Nouvelles, a notable licensing publication. He wrote the winning entry for the regional Nathan Burkan Memorial Copyright Law Competition.
Mr. Baca is an active member of the American Intellectual Property Law Association. He is also an active Board Member in local bar associations and civic organizations. Mr. Baca is also an entrepreneur himself and personally owns several businesses. Mr. Baca is licensed to practice before the United States Patent & Trademark Office as well as the States of Texas and New Mexico.
